Castillo v. Belkorp AG, LLP (CA5 F090527 10/23/26) Arbitration | PAGA

This is an employment-related dispute between defendant/appellant Belkorp AG, LLC (Belkorp) and plaintiff/respondent Stephen Castillo.  Former employee Castillo brought purely nonindividual claims under Labor Code section 2698 et seq., the Private Attorneys General Act (PAGA), against Belkorp.  Belkorp filed a motion to compel arbitration, which the trial court denied.  In this appeal, Belkorp contends the court erred by:  (1) failing to adjudicate the merits of its motion to compel arbitration; (2) concluding that Castillo could maintain a PAGA action alleging only nonindividual PAGA claims; and (3) failing to order the parties to arbitration.  We affirm.
